These Terms of Service ("Terms") govern all access to and use of the products and services offered by Simon & Gloria, including the purchase of vintage, pre-owned, and custom pieces, appointment-based pickups, and shipping. By purchasing a product or otherwise engaging with Simon & Gloria, you acknowledge and agree to be bound by these Terms.
This overview is provided for convenience only and does not replace or limit the full Terms below, which shall prevail in the event of any inconsistency.
Simon & Gloria ("we", "us", or "our") is a business operated by Miriam Amdur in Toronto, Ontario, Canada. Contact: simongloriajewels@gmail.com | 647-823-8440. We do not list a street address on this policy.
By using our website and placing orders through the Simon & Gloria online store, you agree to the following:
You must be of the age of majority in your jurisdiction of residence to form a binding contract, or you must have the consent of a parent or guardian.
You agree to provide current, complete and accurate information for orders and accounts. You are responsible for updating your email, billing and shipping details so we can complete transactions and contact you as necessary.
We reserve the right to refuse service, cancel, or limit orders for any reason, including suspected fraud, unauthorized payment, or breach of these Terms.
All products are subject to availability. We may modify or discontinue products, services or pricing at any time without notice.
Occasionally our site may contain typographical errors or inaccuracies. We reserve the right to correct such errors and to cancel or refuse orders placed based on incorrect information, even after an order has been submitted.
You may not use the site for unlawful purposes, to infringe intellectual property rights, to submit false information, to upload malicious code, or to interfere with the security or operation of the site. Violations may result in termination of access and legal remedies.
We sell vintage, pre-owned, and custom pieces. Each item is unique and, unless explicitly stated, sold 'as-is'. Customers should review all product descriptions and photographs before purchasing.
Customers may collect purchases by appointment at our Toronto office. Appointments must be scheduled in advance by email or phone. We do not publish a physical address on this policy. Once an item is picked up by you or your authorized agent, Simon & Gloria is not responsible for loss, theft or damage.
We ship using reputable carriers. Shipping costs are charged to the customer unless otherwise stated. Shipping timelines are estimates and may vary. Risk of loss and damage passes to the buyer once an item has been shipped or collected.
International customers are responsible for import duties, taxes, customs fees, and any other charges imposed by the destination country. Customs inspections or holds may cause delays; Simon & Gloria is not responsible for customs clearance times or for charges, fines or delays incurred.
If an international shipment is refused or returned due to unpaid duties or other charges, the customer will be responsible for return shipping and any associated fees; these charges may be deducted from any refund issued.
Simon & Gloria endeavours to provide professional services. However, wearing jewelry or having jewelry installed can carry inherent risks, including but not limited to discomfort, skin irritation, infection, allergic or other adverse reactions. By engaging our services or using our products, you acknowledge these risks and agree that Simon & Gloria, its owners, employees and agents are not liable for injuries, complications, or adverse effects arising from use of our products or services. You are responsible for following any care and aftercare instructions we provide and for seeking medical attention when appropriate.
To schedule an appointment, you must provide accurate and complete information. We reserve the right to cancel or reschedule appointments due to unforeseen circumstances or at our discretion. Customers may cancel or reschedule appointments in accordance with our booking policy. Failure to provide required notice or missed appointments may result in forfeiture of deposits or fees.
All prices are shown in Canadian Dollars (CAD) unless otherwise indicated and are subject to change without notice. Payment is due in full at the time of purchase unless otherwise agreed. For pre-booked events or special services, a non-refundable deposit of $500 is required at booking, with the remaining balance due no later than 21 days prior to the scheduled event. We accept the payment methods indicated at checkout or as otherwise communicated. Failure to pay the balance when due may result in cancellation.
We reserve the right to accept or refuse orders for any reason, including product availability, pricing errors, or suspected fraud. If we cancel an accepted order after payment, we will refund the purchase price to the original payment method.
All sales are final. We do not accept returns or exchanges except where required by applicable law. If an item is defective or materially not as described, please contact us within 3 days of delivery or pickup with photographs and a description. We will review and, if appropriate under the law, offer a remedy such as repair, replacement or refund.
We strive to ensure descriptions, measurements, materials and photographs are accurate. Vintage and pre-owned items may show signs of wear, and slight variations in color or appearance may occur due to photography or display settings.
By placing an order you represent and warrant that you are legally capable of entering into binding contracts, that any information you provide is truthful and accurate, and that you will comply with these Terms.
All content on our website (including text, images, logos and designs) is owned by Simon & Gloria or used with permission. You may not reproduce, distribute or create derivative works from our content without our prior written consent.
We collect and use personal information in accordance with our Privacy Policy. By using our services you consent to the collection and use of your information as described in the Privacy Policy.
To the fullest extent permitted by law, Simon & Gloria and its affiliates, owners, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to your purchase or use of our products or services. Our total liability for claims relating to a product or service shall not exceed the amount paid by you for that product or service.
Products and services are provided 'as-is' and 'as-available' without warranties of any kind, except as may be required by applicable law. We make no warranty that the website or services will meet your requirements or be uninterrupted, timely or error-free.
We may revise these Terms at any time by posting an updated version on our website with a revised 'Last updated' date. Changes are effective immediately upon posting. Your continued use of our site or services after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree that any dispute arising under these Terms will be resolved in the courts of Ontario, and you submit to the exclusive jurisdiction of those courts.
